• GENERAL
Art. 1. / 1 / This page contains the general terms and conditions for using the site www.awards.bg, Facebook.com/awards.bg and voting rules of contests "BEST DISCO & NIGHT OF THE YEAR BULGARIA" and "BEST DJ OF THE YEAR BULGARIA", and regulates relationship between any legal person on one side and on the other "Bulgarian Awards Ltd." with registration number 147029433, registered address - Nessebar St., Slavianska No. 2, business and mailing address: 1301 Sofia, 9 A Positano Street, office 24, e-mail: gold@awards.bg, registered as a data controller under the law for protecting personal data, which organizes the contests.

/ 2 / These Terms and Conditions govern the rights and obligations of the parties while using of the informational resources on the website www.awards.bg and all other interactive applications and services accessible from it.

Art. 2. Throughout the general terms and conditions page, the following words shall have the described definition: 1. "The site is the website www.awards.bg & Facebook application Facebook.com/awards.bg, enabling users to gain access to information or access services through links to resources owned by Bulgarian Awards LTD. 2. An "Administrator" is Bulgarian Awards Ltd., which holds the rights to administer the site www.awards.bg 3. A "User" is any person who uses the Internet information resources and services on the site www.awards.bg & Facebook.com/awards.bg. Acceptance of Terms and Conditions is a prerequisite for acquiring that status. The user utilizes all the rights and performs all obligations under the General Terms and Conditions and other rules for using the site, 4. A "Service" is given to the user of the website opportunity to use multiple times information resources and / or other interactive applications, satisfying their intangible need. 5. "Contests" are the contests" BEST DISCO & NIGHT CLUB OF THE YEAR BULGARIA" and "BEST DJ OF THE YEAR BULGARIA", organized annually on the territory of Republic of Bulgaria, by Bulgarian Awards Ltd. which are held online in different categories in order to promote and support the Bulgarian disco artists and nightclubs and discos in Bulgaria.

Art. 3. The site can be used by a user accepting these Terms and Conditions. Every opening of a web page on the site is considered agreement with the T's and C's.

Art. 4. / 1 / The starting point for the use of the site is considered the entering of the address www.awards.bg or facebook.com/awards.bg into a web browser, including the time of loading the home page.

/ 2 / The end point of using the site (exiting the site) is considered the closing of all pages of the site by the user.

/ 3 / The General T's and C's apply to users from the start to the end of using the site.

/ 4 / In the event that the services are used without the real time presence of the user, the General Terms and Conditions apply also during their use.

Art. 5. / 1 / The General Conditions Terms and Conditions may be amended by the Administrator at any time.

/ 2 / The users are entitled to make proposals to change the Terms and Conditions. However, these proposals are not mandatory for the administrator.

/ 3 / The administrator is required to announce amendments to the General Terms and Conditions. They are considered communicated with the users since their publishing on the site.

/ 4 / The effect of the amendments of the T's and C's are active since the time of their announcement on the site. Users are bound to accept them in the ways mentioned above.

/ 5 / Amendments to the General Terms and Conditions are not applicable to the user he notifies the Administrator in writing that he refuses to accept them. Renunciation shall be communicated to the administrator within three days of the notification of amendments.

• USE OF THE SITE
Art. 6. / 1 / The user at his own expense provides suitable computer configuration, operating system and Internet access to use the site.

/ 2 / The administrator bears no responsibility if the users can't use the site or its services due to any reason, standing outside of his perimeter.

Art. 7. While using the site and its services, the user is required to comply with existing regulations, rules for Internet usage, the rules of morality, decency and General Terms and Conditions.

Art. 8. The user agrees not to commit acts which constitute of unlawful intervention in the computer programs which ensure the functioning of the site, including but not limited to - interference with the server or the network etc.

Art. 9. / 1 / The user is obliged when using the services, including but not limited to nominating and voting participants in the contests, not to publish information or to objectify in any form and manner statements containing: - national, religious, political , racial, ethnic intolerance - insult and / or libel against any person - a threat to life and privacy - a threat to commit a crime - calling for the forcible change of the established order of government - with an advertising message commercial purposes - classified or other protected information - a proposal for signing trade deals - information about the privacy of third parties - pornography and / or having a pedophile orientation - any information against the law and the rules of morality;

/ 2 / Upon failure of the preceding paragraph, the administrator has the right to immediately terminate access to the statement in question and to temporarily or permanently terminate the user access to the services or the site. The criteria for the correctness of the statement shall be determined entirely by the administrator.

/ 3 / The administrator has no responsibility for such users' statements and their publications online.

• COPYRIGHT. EXCLUSIVE RIGHT TO USE
Art. 10. / 1 / Any parts of the site content, including but not limited to: design, computer programs (software), database, text, pictures, graphics, information and the rights over them, are owned exclusively by the administrator or the administrator has exclusive rights to use them, and are subject to copyright under the Copyright and related laws, and are protected by the same.

/ 2 / The user agrees not to use (except as permitted by the General Terms and Conditions), reproduce, modify, or perform other illegal actions on any part or the entire content of the site.

/ 3 / Users can access resources on the site, only within the law and the General Terms and Conditions.

Art. 11. / 1 / The user agrees to grant the administrator the right of exclusive use of the information which he has posted on the site, including where the same is subject to protection by the law of copyright and related laws.

/ 2 / The administrator acquires all rights granted under the right of exclusive use and can exercise them within the law.

• Administrator rights
Art. 12. / 1 / The administrator has the right to: at any time amend, supplement, suspend use of the service or element of the service, the site content in whole or part of it - this right can be exercised without warning; to restrict or terminate the access to the site content or services for all users or one of them - this right can be exercised without notice; to delete, move or edit the content or information, including information published by the user contrary to the General Terms and Conditions. The contradictions criteria are determined solely by the administrator. This right does not impose an obligation on the administrator, to suspend or restrict access of users who break the General Terms and Conditions;

/ 2 / In exercising the rights under the preceding paragraph, the Administrator is not responsible in front of the users.

Art. 13. The administrator has the right to retain information published on the site. This right does not impose an obligation on the administrator.

Art. 14. The administrator is not liable in the following cases: - if the services are affected by computer viruses or programs and networks, limiting or terminating the normal functioning of the computer configurations and / or programs of the user; - for the content published by the users including the credibility of data; - when users publish information which violates the rights of third parties; - for damage to computer configurations, computer programs or communications facilities, including loss of data that occurred while browsing the site and using services on the site; - for the behavior of users during the usage of information resources on the site and / or services; - if a third party person uses the payment services (or access to them) or the phone number of the registered user with or without his consent.

• Personal data
Art. 15. / 1 / The use of the site and the adoption of the General Terms and Conditions is voluntary.

/ 2 / In the event that the use of certain information resources and / or services on our site require registration and / or an indication of personal data, the user must make the registration personally.

/ 3 / With the filing of an application for registration (after filling the registration form) the user has consented to the storage and handling of all personal data provided.

Art. 16. / 1 / In the case of use of information resources and / or services for which registration is required and / or an indication of personal data, the user must specify the required data in a good will manner.

/ 2 / An indication of bad will for presenting personal data is considered the following cases: indication of data that does not meet the actual status to which it relates; indication of the personal information of another person, including presentation in a foreign identity.

/ 3 / The administrator has the right to refuse access to the user for information and/ or resources and / or services, requiring registration and / or an indication of personal data, in case the user is known or can be presumed to present data on bad will.

/ 4 / The administrator is not responsible and does not owe compensation to the person whose personal data has been used by another person, whether or not this user has given consent.

Art. 17. Each user has the right to access and amend his personal data in the manner provided in the law for protecting personal data.

Art. 18. / 1 / Every person who has found that a third party has used his personal data for registration can inform the site administrator about it.

/ 2 / The person who thinks that his personal data may be used without his consent by another person may request the administrator to prohibit the registration of this data.

/ 3 / In the case the personal data has already been used by a third person, the person (whose data has been used illegally) may request the administrator to prohibit its use, respectively, to delete the registration by presenting convincing evidence that the data in the registration form or his identity has been used by a third person. The administrator determines the credibility of the evidence and their relevance to the case.

/ 4 / The activities in the preceding paragraphs of this Article shall be made in person or by other person with explicit authorization with notarized signature, to the address for correspondence of the administrator referred to in Article 1, paragraph 1 above.

Art. 19. / 1 / The administrator processes and stores personal data of users in strict accordance with the Law of Protection of Personal Data. The administrator is the "data controller (administrator of the data)" within the meaning of the law.

/ 2 / The administrator may use the personal data of the site users solely for the purposes mentioned in the law and the General Terms and Conditions.

/ 3 The personal data is processed and stored on computer or paper. The computer programs and configurations that have been installed are protected by the respective methods and means.

Art. 20. / 1 / By accepting these Terms and Conditions, the user agrees the administrator to store and perform processing of personal data supplied, subject to the Law of Protection of Personal Data to / with the following objectives: for use for the informational resources and services in the site, adjusting the services offered in the interests of users, advertising, statistical purposes and to provide personal data to third parties in connection with the administration and maintenance of the site, sending an invitation to the users for events organized by administrator or its partners (partners and sponsors), implementation of advertising by the administrator or his contractors.

/ 2 / In case of disagreement on the use of the personal data, the user must notify the Administrator in writing.

Art. 21. The Administrator shall not alter or disclose users' personal data and not provide the collected information to third parties except in the following cases: - there is explicit consent of the user; - the personal data is made available to subcontractors registered under the Law of Protection of Personal Data, for the purpose of the administrating the site - the personal data is made available to partners or contractors registered under the Law of Protection of Personal Data, in connection with the organizing and conducting of the contests, providing of services, or advertising; - the administrator is bound by the law to provide personal data in some specific cases.

Art. 22. / 1 / The user must complete the required data in the registration form in a good will manner.

/ 2 / After filling the data in the registration form, the administrator shall store and process data. He has the right to deny the user access to certain information resources on the site and use of certain services in the event that another registered user has indicated the same data (partly or entirely).

• RULES FOR PARTICIPATION AND CONDUCTION OF THE CONTESTS "BEST DISCO & NIGHT CLUB OF THE YEAR BULGARIA™" & "BEST DJ OF THE YEAR BULGARIA™"
Art. 23 / 1 / The contests "Best Disco & Night Club of the year BULGARIA™" & "Best DJ of the Year BULGARIA™" are conducted online and are organized annually in the Republic of Bulgaria for the promotion and support of the Bulgarian disco artists from the industry and promotion of nightclubs and discos in Bulgaria.

/ 2 / The contest "Best DJ of the Year BULGARIA™ 2012" consists of the following categories: 1.Best DJ of the Year 2.Best DJane of the Year 3.Best New DJ of the Year 4.Best House DJ of the Year 5.Best Techno DJ of the Year 6.Best Trance / Progressive DJ of the Year 7.Best Electronica / Minimal DJ of the Year 8.Best R’n’B / Hip-Hop DJ of the Year 9.Best DNB / Dubstep DJ of the Year 10.Best Retro DJ of the Year 11. Best Resident DJ of the Year 12.Best International DJ of the Year 13.Best DJ Party of the Year 14.Best Bulgarian DJ Track of the Year 15.Best Bulgarian DJ Remix of the Year 16.Best DJ Radio Show of the Year 17.Best Bulgarian DJ Booking Agency of the Year 18.Best Bulgarian DJ Record Label of the Year 19.Best DJ PR / Manager of the Year 20.Best DJ Producer of the Year

/ 2 / The contest "Best Disco & Night Club of the year BULGARIA™ 2012" consists of the following categories: 1.Best Club of the Year 2.Best New Club of the Year 3.Best Live Club of the Year 4.Best Pop Folk Club of the Year 5.Best Summer Season Club of the Year 6.Best Winter Season Club of the Year 7.Best Club Design / Interior of the Year 8.Best Club Chain of the Year 9.Best Club PR / Manager of the Year 10.Best Club Dancer/ Performer of the Year 11.Best Party Photographer of the Year

/ 3 / The administrator reserves the right to change the categories of contests. The changes take effect with their publication the site.

Art. 24 The contests are held at the following stages:

1. First stage - the period from September 27, 2012 till November 30, 2012; during which anyone can nominate, through the appropriate use of the www.facebook.com/awards.bg website their favorite candidates (DJs or clubs) for each of the categories in which the contests are held.

2. Second stage - the period from December 03, 2012 to January 10, 2013 during which everyone can vote for the different categories of the contests. The top 5 nominees from each category from the first stage (those with the most nominations) are announced on the website. During this stage the voting rule says that every user can vote for one of the top 5 nominees from the first stage in each of the categories, thus selecting a winner for each category.

3. Third stage - a gala ceremony which will be held on January 16, 2013 and on which will be announced the winners of each category of the contests. For final winners in each category of the contests are selected those DJs, respectively, those clubs / disco, which have gathered the most votes in the second stage of the contests.

Art. 25 The nominations in the different categories in the first stage of the contests are done by public users, who are identified by their personal Facebook profile.

Art. 26 The voting to select a winner (by category) in the second stage of the contests is done by the public and is identified by the Facebook profile and by SMS.

Art. 27 / 1 / For participation in the contest categories of "Best DJ of the Year BULGARIA™" can be nominated, any person at the age of 18 years or older. Persons nominated for the contest "Best DJ of the Year BULGARIA™" should be clearly individualized by appointing one or more names, or nickname under which they are known as DJs, city and / or club / disco where they are work. Also photos of the nominated DJ can be uploaded, incl. a hyperlink referring to their website or their profile in the internet social networks. Every DJ nominee needs to have at least minimum 3 /three/ own DJ gigs/sets for the past year to enter the contest.

/ 2 / In the categories of the contest "Best Disco & Night Club of the year BULGARIA™" can be nominated nightclubs and discos, operating in Bulgaria. Night clubs / discotheques nominated for the contest "Best Disco & Night Club of the year BULGARIA™" should be individualized, by indicating the name under which it is known, city / resort (possibly address) in which it is located. Also photos of the nominated nightclubs and discos can be uploaded; incl. a hyperlink referring to their website or their profile in the internet social networks. Every Club needs to have at least minimum 1 /one/ month duty for the past year to enter the contest.

/ 3 / The following participants are not allowed to be nominated, voted for and or to take part in the final stage of the contests: DJs, who are among the employees of Bulgarian Awards Ltd., Digital Bulgaria Ltd. or their families in a straight line. If despite that such participation is found, the participants shall be excluded from the contests.

Art. 28 / 1 / All users of the site who have nominated participant or voted for a nominee in the contests, with the fact that he nominates/ votes for a participant declares that possesses exclusive rights of the photos uploaded on the site, and that he has not handed over the exclusive right to a third person.

/ 2 / By uploading a photographic image on the site, the user provides to the administrator, nonexclusive right to use the image including but not limited to the right for: reproduction of the image, spreading around any number of the original and copies of the image, image transmission and retransmission, public display of the image.

/ 3 / The right of use under the preceding paragraph are valid for 10 (ten) years in Bulgaria, being restricted to the use of the photographic image within and in connection with the contests, including in relation to advertising and promotion of the contests in print or electronic media.

/ 4 / In order to avoid any doubt, the user declares that he agrees, the uploaded photographic image to be included in any exhibition of winners of the contests and agrees that the names for which the image is uploaded on the website can to be publicly disclosed.

/ 5 / For the given rights under par. 2 and art. Article 3, the administrator does not owe any financial compensation to the user.

Art. 29 Independently of the previously shown statements and articles and ceded rights, the administrator reserves the right to restrict / terminate the access to the site, incl. remove from participation in the nomination and voting in the contests, a user who has provided photographic image which right does not belong to the user who has uploaded it on the site (according to data supplied by the user) or the creation of photographic works that breaks the law or is clearly obtained through theft or fraud.

Art. 30 The administrator is not liable for claims arising from third parties regarding infringement of copyright and related rights in photographic works uploaded.

Art. 31 The upload of photographic images that include brands, including brands owned by the nominated / selected participants is prohibited.

Art. 32 The upload of images: with erotic or pornographic character or suggestive violence, national, political, ethnic, religious or racial intolerance, or laud or exculpate atrocity or violence, or that are inconsistent with the Bulgarian legislation, public order and morality, is strictly prohibited.

Art. 33 / 1 / The administrator reserves the right to assess which image is considered photographic and which satisfies the terms and conditions. Photographic images that do not meet the requirements, or appear in violation of these terms are removed from the site without users to be notified of the removal.

/ 2 / The administrator is not bound to publish on the site, photographic images sent by the users, and may at any time decide to remove from the site published photographic images at its discretion, as well as when a participant in the contest show reluctance or dissatisfaction of the uploaded image.

/ 3 / The administrator is willing to discuss and evaluate each signal for breaking these terms, and in case the terms are not kept, the administrator has the right to remove the photographic image from the site.

Art. 34 The interpretation in these general terms conditions "to upload a photographic image" is a remote recording of a photographic image by the user on the computer hard disk drive owned or leased by the administrator, through a computer program (software) to which a user is granted access on the site.

Art. 35 The administrator may at any time, respectively at each stage of the contest, make explicit enquiry to each of the categories' participants in the contest, on whether they wish to participate in contest.

Art. 36 / 1 / The administrator may at any time, respectively at each stage of the contests, exclude from participation, each participant who said to the administrator, or upon request by the administrator refused to give explicit consent to participate in the contests.

/ 2 / In the event that a participant has stated that he wishes not to participate in the contests or at the request of the administrator refused to give explicit consent for participation in the contests, then his place is taken by the participant, who received the most nominations after the relevant participant excluded from the contests.

• Rules for nominating participants for the contests "BEST DISCO & NIGHT CLUB OF THE YEAR BULGARIA™ & BEST DJ OF THE YEAR BULGARIA™" via Facebook
Art. 37 / 1 / The vote by Facebook profile is a service provided by the administrator which gives possibility the users to vote for the nomination of participants in each category in the first stage of the contests by using personal Facebook profile.

/ 2 / The vote by Facebook profile is technically restricted and each user can vote only once from his Facebook profile.

Art. 38 / 1 / With the nomination via Facebook profile for participants in the first stage and / or vote via SMS nominees in the second stage of the contests, the users agree their Facebook profile, respectively phone numbers which have sent SMS, to participate in a lottery to receive free prizes provided by sponsors and partners of the contests. The type and number of the awards are published on the site.

/ 2 / Any user who has nominated participants in the first stage and / or voted for the nominees in the second stage of the contests and has won a prize, agrees to be filmed upon receiving/utilizing his prize and to have his photographs / or video advertising material with him published on the www.awards.bg site or the site sponsor / partner of the contest which provided the corresponding prize.

/ 3 / The prizes will be announced in the third stage (final) of the contests. Prize winners are determined among the users who sent e-mails for nominating participants, and among those who voted by SMS for nominees. The prize winners are informed about the won prize via the Facebook profile or the telephone number he had used in the nomination/ voting.

/ 4 / The prizes can't be transferred to others and can't be used under other conditions than those specified in the prize terms and conditions.

Art. 39 / 1 / The users who have nominated participants in the first stage, and / or voted for the nominees in the second stage of the contests and have won a prize will be announced till January 30, 2013 on the website www.awards.bg .

/ 2 / In the event that any of the prize winners are not over 18 years, they will lose their right to receive / use the prize. In this case the award will be given to the next users chosen in the lottery and over 18 years old.

Art. 40 / 1 / The administrator is not liable if any of the sponsors / partners of the contests does not provide the promised prize to the corresponding users.

/ 2 / The administrator is not responsible for the quality of the prizes. Claims for defects shall be brought to the sponsors / partners of the contests, which provided the prize.

/ 3 / The administrator has no obligation to keep correspondence regarding claims for prizes brought by users who are not published on the site www.awards.bg as prize winner.

Art. 41 The users who have nominated participants in the first stage, and / or voted for the nominees in the second stage of the contests, by accepting these terms and conditions confirm that they agree to be e-mailed with commercial messages, including emails for publicity purposes by the administrator and the sponsors / partners of the contests.

• Voting rules for the contests "BEST DISCO & NIGHT CLUB OF THE YEAR BULGARIA™ & BEST DJ OF THE YEAR BULGARIA™" via SMS
Art. 42 / 1 / The vote through SMS (short text message) is a service provided by the administrator, which gives possibility for the users (clients) of the authorized public telecommunications operators – "Mobiltel Ltd." (Mobiltel), "Cosmo Bulgaria Mobile Ltd." (Globul), "BTC Mobile Ltd." (VivaCom) by using their phone numbers and phones to send SMS and vote for participants in the contests.

/ 2 / The voting via SMS allows only one SMS from a SIM-card for each of the categories in the contests.

Art. 43 / 1 / The vote is done by users by sending SMS to numbers provided by a licensed public telecommunications operator.

/ 2 / The numbers for voting via SMS, corresponding to the nominated participants in each category of the contests are announced on the site or in another public way during the second stage of the contests.

Art. 44 / 1 / The service for voting via SMS is paid. The price is equal to the fee for sending SMS to the corresponding number, which is 1.20 leva incl. VAT.

/ 2 / The service fee is collected by the licensed public telecommunications operator under the contract between it and the person whose phone number is used.

/ 3 / The administrator is not responsible and does not owe compensation to the person / user whose phone number has been used by a third person.

Art. 45 / 1 / The user who uses the service agrees that the quality of service depends on: 1. the used by him mobile phone, 2. the load of the network of the licensed public telecommunications operator, which subscriber or user is he 3. the technical and technological condition of the equipment and computer programs serving the service, irrespective of whose control it is 4. his relationship with the licensed public telecommunications operator; 5. his current location and his connectivity with the network of the licensed public telecommunications operator;

/ 2 / The person / user who uses the service agrees that the administrator may at any time to stop the service, regardless of the cause.

/ 3 / The administrator is not responsible and does not owe compensation to the user, if he can't use the service or it is not in the corresponding level of quality for any reason, standing outside the administrator.

/ 4 / The administrator is not responsible and does not owe compensation to the user, if he can't use the service or it is not in the corresponding level of quality, due to failure in keeping the service availability by the telecommunications operator or third party standing between the operator and the administrator.

Art. 46 / 1 / When sending an SMS, to any of the numbers of the nominated participants votes shall not objectify statements containing: - national, religious, political, racial, ethnic intolerance - insult and / or libel against any person - a threat to life and privacy - summons to commit a crime - calling for the forcible change of the established order of government - an advertising message for commercial purposes - classified or other protected information - a proposal for concluding commercial transactions - information about the privacy of third parties - pornography and / or having a pedophile orientation - any information contrary to law, rules of morality and decency.

/ 2 / In case of contravention of the above paragraph, the administrator has the right to remove from participation in the voting stages of the contests a person (relevant number) that has sent text containing the statement referred to above paragraph.

• Closing articles
Art. 47 Additional information related to the contests "Best Disco & Night Club of the year BULGARIA™ & Best DJ of the Year BULGARIA™" and the site, can be obtained by sending a request email to gold@awards.bg or by using the contact form on the site www.awards.bg, as well as reading any additional information published on this site.

Art. 48 The participation and voting for the contests take place under these current Terms and Conditions and the special rules.

Art. 49 The administrator has the rights or has exclusive power over the texts and all the other information published on this site. The usage by third parties is allowed only within the law and after prior written consent by Bulgarian Awards Ltd., and after payment of the requested compensation, except the permitted in these terms and conditions cases.

Art. 50. By accepting these T's and C's, the user declares and confirms that he is at least 18 years old and gives his consents his personal data to be stored and processed by the administrator and to be provided to third parties under the rules of these terms and conditions.

Art. 51. All the user messages to the administrator should be sent to the following address: Bulgarian Awards Ltd. , Bulgaria, 1301 Sofia , 9 A "Positano Street", office 24; e-mail: gold@awards.bg.

Art. 52 The current General Terms and Conditions and the special rules become active upon their announcement / notification of changes.

Art. 53 The administrator reserves the right to supplement or change the rules of the General Terms and Conditions, the changes take effect only after publication on www.awards.bg .

Art. 54 The initial version of the General Terms and Conditions and the special rules becomes active on 09/27/2012.
